Terms of Service
Welcome to Rose Play. These Terms of Service (“Terms”) govern your use of our mobile games, this website (the “Site”), and any related services (together, the “Services”). By downloading, installing, or using our games or the Site, you agree to these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 13 years of age (or the minimum age required in your country) to use our Services. If you are under 18, you should use the Services only with the consent of a parent or guardian. - Reverse engineer, decompile, or disassemble our software except where permitted by law
- Use the Services for any illegal purpose or in violation of any laws or third-party rights
- Harass, abuse, or harm other users or our staff
- Remove or alter any copyright, trademark, or other proprietary notices
We may suspend or terminate your access to the Services if you breach these Terms or for any other reason we consider appropriate.
3. In-App Purchases and Virtual Items
Some of our games offer in-app purchases (e.g. virtual currency, items, or ad-free options). All such purchases are processed by the platform (e.g. Google Play). By making a purchase, you agree to the platform’s payment and refund policies. Except where required by law, in-app purchases are generally non-refundable. Virtual items have no cash value and cannot be exchanged for money or transferred outside the game.
4. Intellectual Property
All content, features, and functionality of the Services (including games, graphics, text, software, and design) are owned by Rose Play or our licensors and are protected by copyright, trademark, and other intellectual property laws. You do not acquire any ownership rights by using the Services. Our name, logo, and game titles are our trademarks.
5. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.
6. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF OTHER USERS OR THIRD-PARTY CONTENT, ADS, OR LINKS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUETILE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Indemnification
You agree to indemnify and hold harmless Rose Play and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
9. Changes to the Terms or Services
We may modify these Terms or the Services at any time. We will post updated Terms on this page and update the “Last updated” date. Material changes may be communicated in-app or by other reasonable means. Continued use of the Services after the effective date of changes constitutes acceptance. If you do not agree to the new Terms, you must stop using the Services.
10. General
Governing law. These Terms are governed by the laws of the jurisdiction in which Rose Play operates, without regard to conflict-of-law principles.
Disputes. Any dispute arising from these Terms or the Services shall be resolved through binding arbitration or in the courts of that jurisdiction, as applicable, and you waive any right to participate in class actions.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Entire agreement. These Terms, together with the Privacy Policy and any platform terms, constitute the entire agreement between you and Rose Play regarding the Services.
